When you suffer severe injuries due to someone else’s negligence, you may wonder what a fair settlement would be from the other party’s insurance. That can be a complex question, but a competent attorney can help you determine what that amount could be. You deserve to be fairly compensated for your injuries and losses, and an experienced attorney is trained to accomplish that.

One thing that’s important to keep in mind when dealing with insurance companies is that they’re looking out for their bottom line over anything else. An offer that they feel is fair may not be fair to you. It’s very rare to have an adjustor that is truly concerned with fairly compensating you for what you’ve suffered, so they often present offers that are much less than you deserve.

How is a Fair Settlement Determined?

In order to determine what a fair settlement amount would be, several factors must be considered. First, property damage. This would include damage to your vehicle, home, or other property involved in the accident. Secondly, loss of income. If you’ve had to take time off work or have been unable to work at all, your loss of income is important to include in your settlement amount. Injuries suffered from accidents can cause extreme financial stress and loss of income can be a large part of that. Next, your medical expenses must be considered. This would include all treatment received from emergency rooms, doctors, chiropractors, specialists or any other medical professionals involved in your treatment. Finally, physical therapy is often required as part of your recovery process. Their fees should be included in your settlement amount as well.

Proof of your expenses will be requested by the insurance company for all your injury-related costs. This includes medical records and billing records. A competent personal injury attorney can request these items & use them in meaningful ways to speak with the insurance adjustor on your behalf. Often, insurance companies will view this data differently than an experienced attorney would, so it’s important to have an experienced professional on your side. The insurance company has adjustors that look out for them, so you need someone looking out for you also.

Another possible component to your settlement may include pain & suffering. These amounts are more complicated to determine because there aren’t specific values associated with them. An attorney who is skilled in this type of case will be able to use your evidence to show how your injuries have caused damage and losses to your quality of life outside of the economic ways listed above.
