The term “pour over will” may be something you’ve heard in regard to estate planning, but what exactly is a pour over will? This document is intended to ensure that any assets not included in someone’s existing trust will be transferred, or “poured over,” to the trust after their passing and once it has gone through probate court. Essentially, it’s a “catch all” to make sure nothing someone owns is left out of their trust.
What is Probate?
And what exactly is probate? This is the legal process that begins when someone passes away & it must be determined who receives control of their assets. This can be a lengthy process & a judge will ultimately decide what happens to assets that belong to someone without a trust or with assets not included in someone’s trust.
