If you’ve been injured while on the job, you may wonder if you’re entitled to worker’s compensation. There are often lots of questions about how the process works, where the money comes from and what types and amounts of compensation are available. Continuing reading for a brief overview of how worker’s compensation works in Missouri. 



Do All Employers Have Worker's Compensation Insurance?

Employers with five or more employees are required to have worker’s compensation insurance. There is a special requirement for construction companies; they must carry worker’s compensation insurance if they have even one employee. Some businesses may opt in to having worker’s compensation insurance even if they are not required to offset the risk of a potential lawsuit. 



Worker's Compensation Claims Process

If you are injured on the job, you must notify your employee immediately. You will be assessed by a doctor to determine the extent of your injuries. If you are concerned about the process, you can contact a worker’s comp attorney. They can help you with the process and ensure your settlement is fair. They are paid on a contingency basis, meaning unless and until you receive funds, they don’t get paid. 

Your employer will file an answer to your claim either admitting or denying the statements made in your claim. Usually, you’ll receive a response within a couple of weeks. If your employer denies your claim, it doesn’t mean it was denied by the Division of Workers’ Compensation. While a denial makes things more complicated, it doesn’t end your case. You will, however, want to contact a lawyer for help. They can ensure the dispute process is handled properly. 



Benefits

Your benefits could include medical care, lost wages or survivor benefits. Medical benefits begin at the time of your claim. Any other non-medical benefits will not start until your claim is accepted. You will have to prove you are entitled to those benefits and proof must be provided.
