Workplace injuries are more common than you might think. When those injuries happen, usually worker’s compensation comes into play. Most people are unfamiliar with how the process works and what benefits they are entitled to. In this blog post, we explore those benefits and common problems injured employees experience.



 There are 3 types of Worker’s Compensation benefits in Missouri:

  • Authorized medical treatment – The employer and/or their insurance company will choose your medical provider and provide a diagnosis and treatment plan for your injury.
  • Temporary Total Disability – For the time in which you are unable to work, you will receive a weekly check. They are equal to 2/3 of your gross average weekly wage.
  • Lump sum settlement – Either by settlement with the Division or Workers’ Compensation or an award from a trial, you can be compensated your permanent disability caused by your injury.


Common Problems for Injured Workers

Many employers and worker’s compensation insurance companies calculate your temporary total disability amount incorrectly. When not represented by an attorney, victims of workplace injury usually receive smaller settlements than if they had hired an attorney. The doctor treating your injury works for the insurance company- not for you- so their treatment may be less than what an independent doctor would have ordered. Sometimes employers will terminate medical treatment if it becomes too costly, even if you are not finished treating. Surgeries or referrals to a specialist might be needed for you to heal properly, but if your employer turns off treatment, those costs will be yours to bear.
